COPPA / FTC Safe Harbor

The Children’s Online Privacy Protection Act applies to organizations that collect or store online personal information from children under the age of thirteen. Websites must post a notice for parents of their information practices including contact information for parents, the type of information gathered, how the information will be used, whether or not it will be shared with third parties and more. The Website must obtain verifiable consent from an adult before collecting or using any information from a child.

FTC Safe Harbor (Federal Trade Commission Safe Harbor)

In order to bridge the difference in approach to privacy between the European Union and the United states, the U.S. Department of Commerce, in consultation with the European Commission, developed a safe harbor framework. The safe harbor is an important way for U.S. companies to ensure EU organizations that their company provides adequate privacy protection, as defined by the European Commission’s Directive on Data Protection.

Standards such as COPPA and FTC Safe Harbor guide organizations in their development and implementation of IT security practices. However, the alphabet soup can be confusing, and organizations can become unsure of how to achieve compliance or when standards compliance is compulsory and when it is optional.
